Prosecutor won't file charges in alleged assault of Forest Park student

CRYSTAL FALLS, MI--   The alleged assault of a Forest Park student did not rise to the level of a crime.

That’s according to Iron County Prosecutor Melissa Powell, who released a statement on the incident 

Thursday morning:

"On or about March 10, 2017, Crystal Falls resident, Tim Daniels, filed a Complaint with the Crystal Falls Police Department alleging his nine year old son was assaulted by a school bus driver when the driver allegedly picked the child up and carried him from the bus to a spot near the school’s bike rack.

"After review of the investigative materials provided to me including witness statements, interviews, pictures, and video, I have determined the conduct did not rise to the level of criminal intent necessary to prove the crime of Assault and Battery beyond a reasonable doubt.

"The student was asked to leave the bus for disciplinary reasons and directed to return to the office to await his parent. Witness statements indicate the student attempted, as he was being escorted from the bus to the office, to run away from the bus driver toward after-school traffic.

"No injuries were reported or sustained by the student in this matter."

Nicole was born near Detroit but has lived in the U.P. most of her life. She graduated from Marquette Senior High School and attended Michigan State and Northern Michigan Universities, graduating from NMU in 1993 with a degree in English.
